1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Fleetify's website, software, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To use Fleetify, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of Service

You may use Fleetify to:

• Manage your vehicle rental fleet
• Process customer bookings and payments
• Track maintenance and analytics

You agree NOT to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble our software
• Resell or sublicense the Service without written permission
• Use automated scripts to scrape data from our platform

4. Fees & Payment

Fleetify offers subscription plans billed monthly or annually. By subscribing, you authorize us to charge your payment method.

• Free Trial: New users receive a 14-day free trial. No credit card required. You'll be charged only after the trial ends if you choose a paid plan.
• Billing Cycle: Subscriptions auto-renew unless you cancel before the renewal date.
• Refunds: We offer a 30-day money-back guarantee. After that, no refunds for partial months.
• Price Changes: We may change our pricing with 30 days' notice. Existing subscribers are grandfathered for 12 months.

5. Data Ownership & License

Your Data: You retain all rights to the data you input into Fleetify (customer records, vehicle information, etc.). We do not claim ownership.

License to Us: You grant Fleetify a limited, worldwide license to host, store, and process your data solely to provide the Service.

Our IP: Fleetify's software, logo, trademarks, and design remain our exclusive property.

6. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted access. We may perform scheduled maintenance (announced 48 hours in advance).

We are not liable for downtime caused by third-party services (payment processors, hosting providers, etc.).

7. Termination

By You: You may cancel your subscription anytime from your account settings. Access continues until the end of your billing period.

By Us: We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in fraudulent activity.

Upon termination, you have 30 days to export your data. After that, we may delete it.

8. Warranties & Disclaimers

The Service is provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

We do not guarantee that the Service will be error-free, secure, or always available.

9. Limitation of Liability

To the maximum extent permitted by law, Fleetify shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from third-party actions

Our total liability shall not exceed the amount you paid in the last 12 months.

10. Indemnification

You agree to indemnify and hold Fleetify harmless from any claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

12. Changes to Terms

We may update these Terms periodically. We'll notify you via email or in-app notification at least 30 days before material changes take effect. Continued use constitutes acceptance.
